$1,000,000 for Dental Assistant Who Developed Silicosis
Our client contracted silicosis while working as a dental assistant, mainly assisting in the making of dental molds.
There were many hurdles in this case. First was the fact the employer had invalid workers' compensation insurance for their employees. After several years, this issue was resolved, and coverage was found.
Second, the new workers' compensation carrier initially offered only $25,000 to settle the worker's case. After several more years with lots of hard work by both our office and the injured worker, and the unfortunate usual ups and downs of a claim, the case settled for $1,000,000.
$900,000+ for Work Fire Death
Our client was a 17-year-old diagnosed with autism. The client’s parent, a US citizen, was killed in a horrible work fire accident for which Cal OSHA cited the employer for multiple safety violations. The client was the child of the deceased and a citizen of Mexico living in Tecata with their other parent. We filed a death claim for the client and also filed a Petition for Serious and Willful Misconduct against the employer for violations of multiple California safety orders.
We were able to negotiate a settlement that paid our client $75,000 up front and a monthly income for the rest of their lifetime. The total value of the settlement was over $900,000.
$750,000 for Uninsured Employer Case
The client worked for a laboratory as a phlebotomist. They developed severe carpal tunnel syndrome from repetitive use of their hands. The client had a problem when it was determined their employer did not have workers’ compensation insurance as required by California law.
When an employer is not insured as required by law, California has a special fund to cover the injuries of employees hurt on the job. This fund has unique procedures for the injured worker to obtain medical care and payments.
We successfully navigated those procedures and obtained a $750,000 settlement for our client.
$730,000 for Truck Driver Injury
Our client suffered a catastrophic accident as a truck driver in July 2007 when the truck they were driving went off the road and rolled down into a deep gully. They were not found for about 24 hours, and due to the accident, they suffered numerous injuries. Sadly, they had to have their right leg amputated below the knee.
Before we represented our client, they were offered a settlement of $92,905 – or 60% permanent disability.
Our client retained us in 2014, and we settled their case for a total of $730,000. The client received $250,000 up front and guaranteed monthly payments of $1,600 for life.
$675,000 for Trip and Fall at Work
The client was working as a property manager when they tripped and fell down a flight of stairs while carrying files in their arms. They had immediate pain in their head, neck, shoulders, and back.
Unfortunately, the medical treatment received was inadequate, and they developed an infection in their spine. After years of complaining about back pain and numerous visits to the ER, a dedicated ER physician figured out the cause of our client’s severe pain was an infection that had spread throughout our client’s spine. Our client was immediately operated on to clean out the infection and put on very strong antibiotics. Unfortunately, a side effect of the antibiotics caused our client to suffer some hearing loss.
After lengthy negotiations, we were able to get our client a $675,000 settlement.
