Why do I need a San Diego workers’ compensation lawyer?
You aren’t legally required to have a lawyer to file a workers’ compensation claim, but getting an attorney on your side can make a dramatic difference. The workers’ compensation system in California is complex, and the insurance companies know it well. If you go into it on your own, you will be at a significant disadvantage. Getting an attorney who has decades of experience handling workers’ compensation cases will level the playing field. We can ensure all your paperwork is filled out correctly, hit all applicable deadlines, and guide you through the process while you focus on getting better.
How much time do I have to report a work injury in San Diego?
Under California law, you have up to 30 days to report a work injury to your employer and remain eligible for workers’ compensation. That said, it’s in your best interests to report the injury as soon as possible so that you can start the process sooner and so that the insurance company has less room to argue that something may have happened in the intervening time to cause your injuries. We also recommend making this report in writing to create a written record.
What does workers’ compensation cover in San Diego?
There are two main types of workers’ compensation benefits. First, workers’ comp pays the full cost of your medical treatment for your work injury, including medical procedures, medication, follow-up appointments with your doctor, and medical devices. There are no co-pays, deductibles, or other out-of-pocket costs. Second, workers’ compensation provides partial replacement of your lost wages if you are unable to work due to your injury. There are additional benefits available if you have a permanent, disabling injury. A workers’ compensation attorney can help you advocate for the full amount of compensation you’re entitled to receive by law.
Can I get workers’ comp if the injury was my fault?
In general, yes. Workers’ compensation is a “no-fault” system, so all that matters is whether you were on the job when the injury happened. There are only a few specific circumstances where your claim can be denied because of fault; for instance, if you intentionally injured yourself.
Can I appeal a denied workers’ compensation claim in San Diego?
Yes, you can appeal the decision to the California Workers’ Compensation Appeals Board. However, the appeals process is complicated and specific criteria must be met in order to get the decision changed. If you don’t already have an attorney, getting a lawyer familiar with the appeals process is critical to win your case.
